Illegal Surgery Trial Continues Minus Juror. Newburyport -- Jury trouble today plagued resumption of the trial of two Greater Boston women in an illegal surgery death case today. When court convened, Judge Paul G. Kirk of the Superior Court was told juror Americo S. DiZazzo of Lawrence had been taken ill over the weekend and was in a hospital. Judge Kirk assembled all counsel at the bench and after a 15-minute conference announced it had been agreed to carry on with 11 jurors. The court announced that Atty. Paul T. Smith, representing Mrs. Juanita Sweet, wife of a Brookline dentist, charged with conspiracy and being an accessory, and Atty. Joseph F. McDonough, for Mrs. Teree Sisto, 37, of Arnold cir., Cambridge, had agreed to proceed with the 11-member panel. They were indicted following the death of Mrs. Ernestine Ball Pacewicz, 28, of Lynn who was found dead in a Salisbury Beach rooming house in 1954. The case has caused a breach between Atty. Gen. Fingold and Essex County Dist. Atty. Hugh A. Cregg. Fingold's office re-opened the case after it had been closed by investigators for Cregg. Trying for the prosecution is Asst. Atty. Gen. Arnold S. Salisbury. Cregg's assistant, Samuel Hyland, has been following with a transcript of the grand jury testimony.
